As of now, electronic cigarettes (e-cigarettes or vapes) are not banned nationwide in enclosed public places under the UK’s main smoke-free legislation (the Health Act 2006 and subsequent regulations in devolved nations). The ban on smoking in enclosed public places, workplaces, and public transport does not legally cover vaping.

However, Vaping Restrictions Are Commonplace

Despite the lack of a national ban, vaping is frequently restricted or prohibited in many public spaces and settings:

  • Workplaces: Employers have the legal right to implement their own policies. Many businesses, offices, and factories ban vaping indoors entirely, or restrict it to designated areas.
  • Public Transport:
    • Transport for London: Vaping is banned on all TfL services (Tube, buses, trams, DLR, Overground, TfL Rail, cable car) and in stations (including on platforms and in ticket halls).
    • National Rail: Most train operating companies ban vaping on trains and at covered station platforms.
    • Buses and Coaches: Almost all operators have no-vaping policies onboard.
    • Aircraft: Vaping is strictly prohibited on all UK commercial flights.
    • Ferries: Banned indoors and often restricted outdoors.
  • Hospitals & NHS Grounds: Vaping is banned in all enclosed areas and buildings within NHS hospital grounds. Policies often extend to the entire outdoor grounds of hospitals.
  • Shops and Shopping Centres: Most large retailers and shopping malls prohibit vaping indoors.
  • Pubs, Bars, & Restaurants: While not mandated by the smoking ban, the vast majority of licensed hospitality venues implement their own policies banning vaping indoors. Always ask staff or check signage.
  • Sports & Entertainment Venues: Stadiums, cinemas, theatres, and concert halls typically ban vaping indoors and often within seated spectator areas.
  • Educational Institutions: Schools, colleges, and universities universally ban vaping both indoors and across their entire premises.
  • Specific Premises: The law explicitly bans vaping in vehicles carrying children under 18 (England & Wales). Premises enforcing the over-18 sale age for tobacco/vapes may also ban its use.

Key Considerations

Look for Signage: Always check for no-vaping signs. Many businesses display clear no-vaping symbols alongside or instead of no-smoking signs.
Respect Premises Policies: Landlords and managers have the right to refuse service and ask individuals to leave for violating their no-vaping policy.
National Differences: Legislation is largely similar across England, Wales, Scotland, and Northern Ireland regarding smoke-free laws excluding vapes. Local enforcement or specific venue rules apply universally.
Future Changes: Legislation regarding vaping, including potential restrictions on use and sales, is constantly under review.
