National Law
Electronic cigarettes are not covered by the Health Act 2006, which prohibits smoking in enclosed public places, workplaces, and public transport in England, Scotland, Wales, and Northern Ireland.
Where Indoor Vaping is Prohibited or Restricted
- All Public Transport: Vaping is banned on buses, trains (including within stations), underground services, trams, airplanes, and ferries operating within UK waters.
- Premises Enforcing Voluntary Policies: Many businesses, including shops, restaurants, pubs, clubs, offices, taxis, and private vehicles used for work, enforce a no-vaping policy. This is at the premises owner’s/manager’s discretion.
- Government/NHS Buildings: Vaping is banned within NHS hospitals and buildings (including grounds in many areas) and most government buildings.
- Schools: Vaping is prohibited for pupils and staff on school premises and grounds.
- Workplaces: While not illegal nationally, many employers prohibit vaping indoors within their buildings or vehicles.
Where Indoor Vaping May Be Allowed (But Not Automatic)
- Private Premises: Individuals can vape in their own homes. Permission is required from the owner/occupier in other private residences (e.g., visiting someone’s home). Landlords of rented accommodation may impose restrictions.
- Designated Vape Shops: Some specialist vape shops may allow customers to try devices/e-liquids indoors, but this isn’t universal.
- Premises Without a Policy: If a business owner has not explicitly prohibited it, vaping indoors may be technically allowed unless other regulations apply (e.g., local authority bans). However, most hospitality venues ban it.
Local Authority Bans
Some local councils have implemented bylaws banning vaping in specific council-owned or operated enclosed public spaces, such as certain civic buildings, museums, libraries, or children’s centres. Always check signage or local authority rules.
General Guideline
Always assume vaping is prohibited indoors unless explicitly permitted or in your private home. Look for no-vaping signs or ask the premises owner/staff for clarification. The burden is on the vaper to confirm if it is allowed.
